1. Acceptance of Terms
By accessing and using the Kalytera platform and services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.
2. Software License
Kalytera is proprietary software. A free Community edition (up to 4 cameras) is provided for personal and evaluation use. Standard, Professional, and Enterprise editions are available under a commercial license obtained through Kalytera.
You may not copy, modify, distribute, sublicense, or resell Kalytera beyond the scope of your purchased license. The Community edition may be used free of charge for non-commercial purposes.
The software is provided "AS IS", without warranty of any kind, express or implied.
3. Use of Service
3.1 Permitted Use
You may use the Kalytera Service for lawful purposes only. You agree to comply with all applicable laws and regulations in connection with your use of the Service.
3.2 Prohibited Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe upon or violate our intellectual property rights or the intellectual property rights of others
- Submit false or misleading information
- Upload or transmit viruses or any other type of malicious code
- Attempt to interfere with, compromise the system integrity or security
- Use the Service to transmit any harmful, threatening, abusive, or objectionable material
4. User Accounts
4.1 Account Creation
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.2 Account Security
You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
5. Licenses and Subscriptions
5.1 License Types
Kalytera offers different license types including Community (Free), Professional, and Enterprise licenses. Each license type has specific features, limitations, and terms as described on our Pricing page.
5.2 Payment Terms
Paid licenses require payment of fees as described on our website. All fees are non-refundable unless otherwise stated. Payment terms are net 30 days from the date of invoice unless otherwise agreed in writing.
5.3 License Validation
License keys may be validated through our licensing server. You agree not to bypass, disable, or interfere with license validation mechanisms.
6. Data and Privacy
6.1 Self-Hosted Data
Kalytera is a self-hosted solution. Video data, configurations, and recordings remain on your infrastructure. We do not have access to your video data or recordings.
6.2 Usage Data
We may collect anonymous usage statistics and diagnostic data to improve the Service. This data does not include video content or personally identifiable information from your video streams.
6.3 Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Intellectual Property
The Service and its original content (excluding user-generated content and open-source components), features, and functionality are and will remain the exclusive property of Kalytera and its licensors. The Service is protected by copyright, trademark, and other laws.
8. Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by Kalytera. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
9. Warranty Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
IN NO EVENT SHALL KALYTERA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.
11. Indemnification
You agree to defend, indemnify, and hold harmless Kalytera and its licensors from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Kalytera operates, without regard to its conflict of law provisions.
